These Terms of Service ("Terms") govern your access to and use of the USA DentBoard Pro mobile application and website (collectively, the "Service") operated by USA DentBoard Pro LLC ("Company," "we," "us," or "our"), a limited liability company incorporated in the State of Delaware, USA. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is intended for dental professionals and students preparing for the INBDE examination.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@usadentboardpro.com of any unauthorized use of your account.
Paid subscriptions are billed in advance on a recurring basis (monthly or annually). Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.
We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price changes. Your continued use of the Service after a price change constitutes acceptance of the new price.
New subscribers are eligible for a full refund within 7 days of their first paid subscription purchase. To request a refund, contact support@usadentboardpro.com within 7 days of purchase. Refunds are not available for renewals or after the 7-day period. Subscriptions purchased through the Apple App Store or Google Play are subject to the respective platform's refund policies.
You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play) or by contacting support@usadentboardpro.com. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes. You may not:
All content in the Service, including but not limited to questions, explanations, clinical notes, flashcards, images, logos, and software, is owned by or licensed to USA DentBoard Pro LLC and is protected by copyright, trademark, and other intellectual property laws. The INBDE® is a registered trademark of the Joint Commission on National Dental Examinations (JCNDE). USA DentBoard Pro is not affiliated with or endorsed by JCNDE.
The Service is provided for educational and exam preparation purposes only. The content is not intended to constitute professional dental advice, clinical guidance, or a substitute for formal dental education. We make no guarantee that use of the Service will result in passing the INBDE or any other examination. Exam content, format, and requirements are subject to change by the relevant examining authorities.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USA DENTBOARD PRO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
You agree to indemnify, defend, and hold harmless USA DentBoard Pro LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Dover, Delaware, or via videoconference. The arbitrator's decision shall be final and binding.
YOU AND USA DENTBOARD PRO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
These Terms constitute the entire agreement between you and USA DentBoard Pro LLC regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
